Welcome to The NiCa Collection (“we,” “us,” “our”), a premium B2B2C marketplace for hair extensions and wigs operated by The NiCa Collection LLC. These Terms and Conditions (“Terms”) govern your access to and use of our website at www.thenicacollection.com (the “Platform”), including any purchases made through the Platform.
By accessing, browsing, or placing an order on the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
The NiCa Collection operates as a curated marketplace connecting customers with vetted third-party vendors (“Vendors”) who sell hair extensions, wigs, and related products. All products listed on the Platform are sold by independent Vendors who have undergone our quality verification process.
While we take significant steps to verify our Vendors and their product quality, individual products are manufactured, described, and fulfilled by the respective Vendor. The NiCa Collection acts as the marketplace facilitator and payment processor, not the seller of record for third-party Vendor products.
4.1 Account Creation
To make purchases on the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.
5.1 Product Information
We strive to ensure that product descriptions, images, and pricing on the Platform are accurate. However, we do not warrant that product descriptions or other content is error-free. Colors may vary slightly due to monitor settings.
5.2 Order Placement
By placing an order, you are making an offer to purchase the selected product(s) at the listed price, plus applicable taxes and shipping. All orders are subject to availability and acceptance.
5.3 No Cancellation After Order Placement
Once an order has been placed and confirmed, it cannot be cancelled. All sales are final upon order confirmation. Please review your order carefully before completing your purchase. This policy exists because our Vendors begin processing and preparing orders immediately upon receipt.
5.4 Pricing and Payment
All prices are listed in U.S. Dollars (USD). We accept payment via credit card, debit card, and other methods available through our payment processor, Stripe. Payment is processed at the time of order placement. Sales tax is calculated and collected based on applicable state and local requirements.

All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of The NiCa Collection or its content suppliers and is protected by U.S. and international intellectual property laws. Vendor product images and trademarks remain the property of their respective owners.
You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, or impair the Platform. Prohibited conduct includes but is not limited to: attempting to gain unauthorized access to any portion of the Platform, using automated means to access the Platform without our express permission, interfering with any other party’s use of the Platform, and submitting false or misleading information.
To the fullest extent permitted by law, The NiCa Collection shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability for any claim arising from your use of the Platform shall not exceed the total amount you paid to us in the 12 months preceding the claim.
You agree to indemnify and hold harmless The NiCa Collection, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
Any disputes arising out of or related to these Terms or the Platform shall first be attempted to be resolved through good-faith informal negotiation. If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Tennessee.
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles.
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after any modifications constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify registered users of material changes.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
